An insurance complaint in Portugal: who to contact

Understand the roles of the insurer, its customer ombudsman and the regulator.

Who this is for

English-speaking policyholders, insured people, beneficiaries or injured third parties dealing with an insurance complaint connected to Portugal.

Identify the insurer and the applicable complaints process, then submit a clear written account through its official channel. The ASF is a supervisor, not a substitute for a court deciding an individual contractual dispute.

Identify the entity before escalating

The brand you dealt with may not be the insurer carrying the risk. Look in the policy for the insurer, any intermediary and the complaints section. For cross-border products, do not assume that the country of the website or your preferred language determines the relevant authority.

Ask the provider to identify the complaints channel and applicable process. Keep this answer with the contract. For an international product, confirm which authority and dispute-resolution process apply to your contract.

Prepare a short, factual account

A claim asks the insurer to apply cover after an event. A complaint challenges a decision, omission or service. If you already have a claim number, include it so the documents can be connected.

Write a dated sequence: what happened, what you submitted, what the insurer said and what you want clarified or corrected. Label your interpretation separately from the documented facts. If you use a translation, keep the original wording alongside it and do not present an informal translation as certified.

Know what each channel does

ASF guidance explains that a complaint should first be presented to the insurer. Further channels have different roles and eligibility conditions.

  • Insurer’s complaints function: reviews the conduct or decision you challenge.
  • Provedor do cliente: the insurer’s customer ombudsman, who can consider eligible unresolved complaints and issue recommendations.
  • ASF: addresses matters within its supervisory powers; it does not award compensation by deciding your private dispute in place of a court.

If you disagree with the answer

Ask for the policy clauses and calculations relied on. When referring the matter onward, include the original complaint, evidence of receipt and the response. Check the current requirements and time limits on the official ASF page and in the ombudsman’s rules.

The Portuguese expression provedor do cliente should not automatically be equated with a binding compensation scheme you know from another country. If you need a binding resolution, obtain information on the courts or dispute-resolution mechanism appropriate to the contract.

Protect documents and deadlines

Do not assume that filing a complaint stops every limitation or contractual deadline. Seek specific advice if time is material. Avoid sending identity or medical documents to unrelated organisations when a secure official channel exists.
